1.Acceptance of Terms
By downloading, installing, or using Niwa Day (the "Application"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Application.
2.Description of Service
Niwa Day is a desktop application that connects to a calendar service and displays your scheduled events for the current day in a semi-transparent floating overlay window. The Application currently integrates with Google Calendar; support for additional calendar services may be added in future versions. The Application provides read-only access to your calendar data and does not modify, delete, or create any calendar events.
Niwa Day is distributed through the Microsoft Store. Your installation and use of the Application is also subject to the Microsoft Standard Application License Terms, available at: Microsoft Standard Application License Terms. In the event of any conflict between these Terms and the Microsoft Standard Application License Terms, the Microsoft terms shall govern the distribution relationship, while these Terms govern your use of the Application itself.
3.Account & Permissions
To use Niwa Day, you must have a valid account with a supported calendar service (currently Google) and grant the Application permission to access your calendar data (read-only). By authorizing Niwa Day, you acknowledge that:
- Niwa Day will request only the minimum permissions required to display your events. For Google Calendar, this is the
calendar.readonlyOAuth scope. - You can revoke Niwa Day's access to your Google account at any time via your Google Account Permissions page.
- Niwa Day's access to any third-party calendar service is subject to that service's own Terms of Service and Privacy Policy.
4.Permitted Use
You may use Niwa Day for personal or professional purposes to view your own calendar events. You agree not to:
- Reverse engineer, decompile, or disassemble the Application.
- Use the Application to access calendar data belonging to other users without their explicit consent.
- Use the Application for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to bypass or circumvent any security measures in the Application.
5.Data & Privacy
Your use of Niwa Day is also governed by our Privacy Policy, which is incorporated by reference into these Terms. In summary:
- Calendar data is fetched in real time and displayed locally on your device only.
- No calendar data is stored on external servers or shared with third parties.
- OAuth credentials are stored securely in the Windows Credential Manager — the operating system's built-in secure credential storage.
- Niwa Day does not collect any usage analytics, telemetry, crash reports, or device identifiers.
6.Intellectual Property
Niwa Day is developed and operated by Jimmy Chen (elminsterii), an independent developer based in Taiwan (the "Developer"). Niwa Day and all associated intellectual property rights (including but not limited to software, design, graphics, and documentation) are owned by the Developer. Nothing in these Terms grants you any rights to use the Developer's trademarks, trade names, or branding.
7.Disclaimer of Warranties
Niwa Day is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. The Developer does not warrant that the Application will be error-free, uninterrupted, or free of viruses or other harmful components.
8.Limitation of Liability
To the fullest extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, Niwa Day, even if the Developer has been advised of the possibility of such damages.
9.Modifications to the Application and Terms
The Developer reserves the right to modify, suspend, or discontinue Niwa Day at any time without notice. These Terms may also be updated from time to time, including to reflect new calendar service integrations. Continued use of the Application after any changes constitutes your acceptance of the revised Terms.
10.Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of China (Taiwan), without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Application shall be submitted to the exclusive jurisdiction of the Taiwan Taipei District Court (台灣台北地方法院) as the court of first instance.
